Truck Accident Resulting in Neck and Back Injuries
Description:
The Florida Highway Patrol investigated the crash, charging the truck driver with "Careless Driving." Our client sought medical evaluation and treatment for his injuries of neck and back pain. Diagnostic imaging (MRIs) of the neck and back revealed disc herniations, with the low back also having nerve root compression. Case proceeded into litigation where the trucking company raised issues significance of impact (calling this a minor impact), also arguing causation of damages. Supplemental investigation, soon after the crash, included additional property damage photographs of our client’s vehicle (showing our client’s vehicle sustained frame damage). Defense then argued Facebook postings or slides of our client; suggesting he lived a normal life, without injuries. Case resolved at mediation, a short time before jury trial.
Take away from this case is the following:
- Critical to obtain best property damage photographs of all vehicles involved in the crash.
- When presenting to doctors, provide ALL of your chief complaints to document your damages; and
- During pendency of your case, yourself, family or friends should not post any pictures of you on social media.
Defense attorneys and insurance companies routinely check social media to obtain photographs of outside activities to argue a different picture. Client was pleased with results obtained.
