Motorcycle Accident Resulting in Neck & Back Surgeries
Description:
An elderly man made a left turn in front of the motorcyclist causing him a closed head injury, C3-4 disc herniation, C4-5 disc herniation with cord impingement, L3-4 disc herniation, L4-5 disc herniation with nerve root impingement, and L5-S1 disc herniation, requiring two surgeries: 1) Cervical discectomies at C4-5 and C5-6 with fusion; and 2) Laminectomies at L4-5 and L5-S1. The other driver would not accept fault for the crash, the case was litigated, the insurance company argued the injuries were pre-existing or unrelated. After deposition of the Defendant, the case settled for the at fault driver's policy limits, also recovering all applicable underinsured motorist coverage, obtaining the best recovery possible. Case resolved in litigation.
