Motorcycle Accident Resulting in shoulder, wrist and other injuries
Description:
The driver of a 2015 Hyundai Elantra made a left turn from an intersection controlled by a stop sign, pulling out in front of a motorcyclist causing an intersection crash. Police investigation and report noted the operator of the Hyundai failed to yield right of way, the motorcyclist was had no contributing action (was not at fault in any way). EMS arrived on scene, rendered first aid to the motorcyclist. Afterwards, he was transported to the local hospital, initially diagnosed as having a traumatic head injury, with injury to his upper arm and shoulder. In the days, weeks and months following, diagnostic studies revealed a fractured wrist, a fractured humeral head and torn labrum of the right shoulder, also diagnosed with three disc herniations/protrusions in his neck. Ultimately, he required surgery of his right wrist, referred to as an open reduction internal fixation (ORIF) with follow-up therapies for his neck. The at fault driver, by deposition testimony, denied fault for the crash suggesting the biker was speeding, yet she never saw the biker beforehand, and she did not have any credibility. Afterwards, her automobile insurance carrier tendered her insurance limits of $100,000. The injured biker had Uninsured/Underinsured Motorist coverage and his carrier tendered an additional $350,000, resulting in a total recovery of $450,000. This case is another reminder of the importance of having Uninsured/Underinsured Motorist coverage; as many at fault drivers do not have sufficient insurance coverage for injuries arising from a motorcycle accident. Case resolved during litigation, before a scheduled jury trial.
