Description:
The driver of a Hyundai suddenly and unexpectedly made a left turn at an intersection violating the biker's right of way. The Florida Highway Patrol investigated the crash issuing a citation to the at fault driver for "Failure to Yield Right-of-Way." Initial medical records diagnosed the biker with multiple complaints of pain, fatigue and weakness, also having road rash to his right leg, abrasions and swelling to his right ankle. MRI of his neck revealed four disc herniations. MRI of his Low back revealed two disc herniations, both having nerve root impingement. MRI of right ankle revealed swelling, cartilage issues and tenosynovitis. Repeat MRI of the neck revealed worsening neck injury, and his surgeon recommended surgery, a C6-C7 discectomy and fusion.
The at fault driver had Bodily Injury limits of $100,000, without any excess liability insurance or personal assets. The biker did not have any motorcycle insurance or automobile insurance. Ultimately, we obtained recovery of the at fault driver's $100,000 limits, obtaining best possible financial recovery under the circumstances.
This is a reminder of the following:
- Motorcycle accidents often times result in "significant injuries" many times with recommendations of surgery with costly medical bills.
- In Florida, bikers cannot rely on others to carry sufficient insurance for such injuries. Every biker should make sure to have their own insurance, making sure to have Uninsured/Underinsured Motorist coverage, the highest limits you can reasonably afford – for the financial protection of yourself and your family.
