Motorcycle Accident Resulting in Fractured Collar Bone Injury


Description:


The driver of a Dodge truck made a left turn violating the right of way of a motorcyclist. When police arrived, the driver of the truck denied responsibility, blaming everything on the motorcyclist, saying the biker traveled at an excessive speed. The investigating officer placed the biker at fault on the crash report, also listing a separate witness who also said the biker was speeding. By supplemental investigation, the biker canvassed the scene visiting a nearby business asking if for anyone witnessed the crash. Not only did he learn of someone on a lunch break who witnessed the crash, he also obtained a copy of their business video - capturing the entire crash on video. The video clip revealed the truck turned left immediately in front of the biker, the biker was not speeding and the crash happened in his lane of travel.

For injuries, the biker suffered from a fractured collarbone and road rash. During litigation, the driver of the truck testified the biker was speeding, also testifying the biker "swerved" into the parking hitting her vehicle. The video "disproved" all of her deposition testimony – leaving her with no credibility. Afterwards, her insurance company tendered her policy limits just before jury trial. The take away from this case is the importance of supplemental investigation. The surveillance video of the nearby business (documenting the entire crash) held the at fault driver accountable for her actions.
