Description:
Our client, a 52 year old male, operated his 1997 Harley Davidson motorcycle when a lady driving a BMW automobile ran a stop sign, causing a motorcycle crash. Afterwards, our client was diagnosed as having a left shoulder full-thickness tear of his supraspinatus tendon with retraction, also resulting in surgery. The at fault driver's insurance company argued the shoulder injury was a pre-existing condition.
Note:
Through litigation, we were able to prove the motorcycle crash caused an aggravation to a pre-existing condition; and, the case resolved in litigation.
