Motorcycle Accident Resulting in a Right Tibial Fracture & Fibular Neck Fracture.
Description:
A 1999 Chrysler Sebring came to a complete stop at a posted stop sign at an intersection, then proceeded to make a left turn and entered directly into the path of a motorcyclist having the right of way. The motorcyclist took evasive action to avoid a possible collision with the car by swerving to the right; and by doing so, he lost control of his motorcycle, laying the motorcycle down. The crash report noted this constitutes a "non-collision", still found the driver of the car at fault for causing the crash, citing the at-fault driver for failure to yield the right of way.
Note:
This is an example where you can hold the other driver accountable for the careless or reckless driving although there was no contact between the vehicles. Case resolved for policy limits.
