Motorcycle Accident Resulting in Breast Back Injuries
Description:
50-year-old female operating a 2020 Harley-Davidson Softail involved in a collision with a Nissan Maxima that violated her right-of-way. The driver of the Nissan Maxima was making a left-hand turn from the driveway of a shopping complex, pulling out of the driveway and stopped in the middle of the road, violating the right of way of the motorcyclist. The motorcyclist saw the vehicle violating her right of way, hit her brakes to prevent her from hitting the car, and then fell over the side of her motorcycle, with the bike then sliding forward into the car. Her chief complaints of injury on scene included injuries to her chest (plus other injuries) and she was transported by the local fire department to the nearest hospital. The driver of the Nissan Maxima was cited for failure to yield oncoming traffic.
Ultimately, the biker was diagnosed with multiple injuries including but not limited to chest injury, hip injury, multiple abrasions (road rash), wrist injury, left breast implant deflation (requiring surgery) and a disc protrusion in her low back, requiring pain management, receiving nerve blocks and epidural steroid injections. Investigation revealed the at fault driver had bodily injury liability limits of $100,000,00, no additional assets, and our client herself had a motorcycle insurance agreement having underinsured motorist coverage of $10,000.00, also having an automobile insurance agreement with underinsured motorist coverage ("Stacked") of $20,000, allowing us to obtain total recovery of $130,000.00.
Clearly, this biker had damages well in excess of the at fault driver's insurance coverage and was smart to have underinsured motorist coverage in both her motorcycle and automobile insurance policies.
