Description:


A vehicle in front of the motorcyclist pulled into the center lane and then without warning swerved back into the through lane causing the motorcyclist to apply his brakes, causing him to lose control, causing him to be ejected, causing him road rash and a broken leg. There was no contact between the two vehicles. Supplemental crash investigation found the driver of the vehicle at fault for causing the motorcyclist to crash. The injury claim resolved for policy limits of the at-fault driver and the underinsured motorist limits.
