Automobile Accident Resulting in Neck Surgery

Description:

A driver of a 2012 Nissan Altima stopped to make a left turn into the parking lot of a private business. Traffic for the opposite direction of travel was backed up with traffic and blocked the view of the driver, she was waived on to turn left and she violated the right of way of our client causing a significant crash between the vehicles. Our client, 54 years of age, had a prior medical history of neck pain. After this collision, she was diagnosed with two cervical disc herniations requiring surgery, having complete discectomies with total disc replacements. We obtained the prior MRI study of her neck and requested an independent radiologist to review the prior MRI study to the MRI study taken after this crash; and, the comparison study "proved" this collision caused both disc herniations, non-existent on the prior MRI study.

Litigation Followed Including:

  • obtaining the prior MRI study of her neck and requested an independent radiologist to review the prior MRI study to the MRI study taken after this crash;
  • comparison study "proved" this collision caused both disc herniations, non-existent on the prior MRI study.

Case resolved pre-suit for policy limits.
