Automobile Accident Resulting in Back Injuries
Description:
Rear-end collision by a Jeep Grand Cherokee causing a 58 year old male chief complaints of neck and back following the crash. He had a pre-existing history of low back pain and presented to a chiropractic physician. Afterwards, he was referred to a pain management specialist for ongoing low back pain. MRI of his middle back revealed multiple thoracic herniations. MRI of his low back revealed an L3-4 disc herniation with nerve root impingement. With pain management, he underwent thoracic and lumbar injections, a Lumbar Medial Branch Block, and also had a Radiofrequency Ablation in his low back. Ultimately, he was referred to a surgeon for low back surgery, resulting in a laminectomy at L3-4. The at fault driver had automobile insurance having Bodily Injury liability limits of only $50,000.00. Our client had Uninsured/Underinsured Motorists coverage limits of $200,000.00. Both carriers tendered all limits after litigation was filed.
This case illustrates the importance of:
Having Uninsured/Underinsured Motorist coverage in your own automobile insurance policy, having the highest limits you can reasonably afford to protect yourself and your family – as bad drivers typically do not have sufficient insurance coverage compared to the overall damages.
