Description:


18 year old female was the victim of a significant intersection crash where an elderly driver (making a left turn) failed to yield right way, making an improper left turn. Initial medical records diagnosed her with a C5-6 disc herniation, C-6 disc herniation, T1-2 disc herniation, L4-5 disc herniation and other injuries as a result of this severe/significant intersection crash. The at fault driver had Bodily Injury liability coverage of $250,000.00. Our client herself also had Underinsured Motorist coverage. Case resolved in litigation after case was set for jury trial with related depositions, with the insurance company for the at fault driver tendering the at fault driver's insurance limits. The Underinsured Motorist carrier served a nominal Demand For Judgment upon the Plaintiff, we in turn served a counter Demand For Judgment upon the Underinsured Motorist carrier served a Notice of Acceptance of our client's Demand For Judgment, rather than face the possibility of an excess judgment being entered against them. With no prior history of any accidents beforehand, good property damage photographs, timely medical treatment and radiographic studies (MRI studies) providing clear and objective proof of injury, we were able to definitively prove our client suffered lifetime/permanent injuries as a result of the crash, and she obtained a significant financial recovery.


Litigation Followed Including:

  • Counter Demand For Judgment upon the Underinsured Motorist carrier served a Notice of Acceptance of our client's Demand For Judgment, rather than face the possibility of an excess judgment being entered against them.
