Automobile Accident Resulting in Soft Tissue Injuries

A Chevrolet pickup truck violated the right of way of our client at an intersection, resulting in a 35 mile per hour crash, totaling both vehicles. MRI of his low back revealed he had a disc bulge, also having two disc herniations, with nerve root impingement. Afterwards, he was referred to a pain management doctor and had procedures including a medical branch block and a Radiofrequency ablation. Investigation revealed the at fault driver had automobile insurance having liability limits of only $15,000. Additional investigation revealed our client had Underinsured Motorist coverage or limits of $50,000. Immediate demands were made upon both insurance companies for the above limits, and both tendered in a timely manner, resulting in a total recovery of $65,000.

This case is yet another example of the importance of having Underinsured Motorists coverage in your automobile insurance agreement, the highest limits you can reasonably afford. Another take-away from this case is having an aggressive attorney, to obtain the maximum insurance limits available, in a timely fashion without having to file suit, to saving the client from increased attorney's, costs, obtaining best results possible under the circumstances.
