Automobile Accident Resulting in Serious Injuries – L3/4 Disc Herniation
Description:
The driver of a Honda Civic ran a red light at an intersection causing a severe high-speed T-bone collision to our client's vehicle, totaling both vehicles. The at fault driver initially denied fault for the collision stating he had the green light. Our client had a dash cam recording the event, showing he had the green light at the intersection and the other driver clearly ran the red light at a high-speed. Afterwards, our client was diagnosed with multiple cervical disc bulges, and L3–4 disc herniation and with a loose body in his right wrist, requiring pain management, injections, consultation with an orthopedic surgeon and such injuries caused him significant lost wages and medical bills. Investigation revealed the at fault driver had Bodily Injury liability limits of only $50,000. Our client, by his automobile insurance agreement, had Uninsured/Underinsured Motorist coverage of $50,000. Immediate demands were submitted to both insurance companies, the at fault driver's insurance company tendered the limits of $50,000. Our client's automobile insurance company tendered the limits of his Underinsured Motorist coverage resulting in a total recovery of $100,000 for our client. This case again illustrates the importance of having Uninsured/Underinsured Motorist coverage in your own policy, to protect yourself and your family. Otherwise, had this client not had such underinsured motorist coverage, he would have been out of pocket for thousands of dollars of outstanding medical bills and lost wages; and in all likelihood, he would have had to have filed for bankruptcy.
Fortunately for him, he was smart, and he had underinsured motorist coverage.
