Description:
An uninsured motorist operated a carelessly and negligently operated a vehicle, turning left at an intersection, failing to yield to a pedestrian who clearly had the right of way. The at fault vehicle struck the pedestrian at approximately 15 miles per hour, the driver was charged with “Failure To Yield Right-Of-Way, and the driver claimed to have insurance with Direct General Insurance Company. EMS was on scene, resulting in emergency transport to a local emergency room. Crash related diagnoses revealed our client suffered from a right knee injury including a displaced lateral tibial plateau fracture, also having a torn medial meniscus. Supplemental investigation revealed the at fault driver did not have any Bodily Injury liability coverage. Fortunately, our client had an automobile insurance agreement having Uninsured Motorist (UM) coverage. Following a lawsuit against the carrier, after discovery, the carrier tendered the UM limits of $100,000, resolving the case without additional litigation expenses of deposition(s), mediation or otherwise.
This is yet another example of the importance of having Uninsured Motorist coverage in your automobile insurance agreement, as it will follow you even when you are a pedestrian hit by an uninsured motorist. Had our client not had such coverage, she would have been out-of-pocket for thousands of dollars of outstanding medical bills, through absolutely no fault of her own.
