Description:
Our client travelled as a front seat-belted passenger in a 2004 Mercedes Benz; and, his driver made operated this vehicle in a negligent, careless and reckless manner by making sudden left turn at an intersection, violating the right of way of a vehicle travelling the opposite direction, causing a significant crash, also causing a collision with a third vehicle. Our client was diagnosed with neck and back injuries, also requiring surgical procedures including a C6-7 Laminectomy, foraminotomy and possible facetectomy. The at fault driver had insurance with Amica, having bodily injury liability coverage of $50,000.00; and, our client had an automobile insurance agreement with Mercury Insurance Company, having underinsured motorist coverage of $100,000.00; both carriers tendered policy limits, for total recovery of $150,000.00.
